LITIGATION UPDATE
(1) The United Retired Pilots Benefit Protection Association (URPBPA)
and Air Line Pilots Association (ALPA) appeal of Judge Wedoff's
decision approving the termination by the Pension Benefit Guaranty
Corporation's (PBGC) of the United Airline Pilots' Defined Benefit
Pension Plan has been assigned to Judge Darrah in Federal District
Court in Chicago.
The parties appeared before Judge Darrah on December 15, 2005. URPBPA
and ALPA argued for an expedited appeal process and the PBGC requested
that Judge Darrah not expedite the process. The PBGC argued that they
would need additional time to prepare their case due to its complexity.
Judge Darrah ruled that the proceedings would be expedited and he set
the following schedule for the appeal:
December 22, 2005- All initial briefs.
January 5, 2006- All opposition briefs.
January 12, 2005- All reply briefs.
Judge Darrah will rule on the appeal soon after the final briefs are
filed.
(2) The final briefs have been filed in United Airline's appeal of
Judge Wedoff's decision ordering United to pay retired pilots the
October non-qualified pension payment. Judge Darrah will rule on the
appeal soon. He is not going to schedule oral arguments before
deciding the case.
(3) Final briefs have been filed in URPBPA's appeal to the Seventh
Circuit Court of Appeals of the Bankruptcy Court's approval of the
ALPA-United agreement. The Seventh Circuit Court will hear oral
arguments on URPBPA's appeal on January 10, 2006, at 9:30 AM. The
court will not rule on the case on January 10, but it will consider
the issues and rule at a later date.

The United Retired Pilots Benefit Protection Association has filed its
objections to UAL's Plan of Reorganization with the Bankruptcy court.
The objections fall into four categories:
1) Retired pilots' inequitable loss of pension benefits compared to
ALPA and the active pilots;
2) Inclusion of non-debtor parties in the release provisions;
3) United's failure to provide ballots acknowledging the non-qualified
claims of pilots retiring in 2005; and
4) The Management and Director Equity Incentive Plans' violation of
the code.
